Terms of Use

These Terms of Use (“Terms”) form an agreement between you and Wewin Software (“we”, “us”, “our”) governing your use of the Volume Booster & Equalizer mobile application (the “App”). Please read them carefully, in particular section 5 on hearing and device safety — by installing or using the App you accept these Terms.

The short version

The App raises the loudness of audio your device is already playing. Loud audio can damage your hearing and your speakers or headphones — you decide how loud to make it, and you accept that risk. The App is free, ad-supported, and provided “as is”; how much boost is possible depends on your device. This summary is for convenience only — the full Terms below govern.

01 Acceptance of these Terms

By downloading, installing, or using the App, you confirm that you can form a binding contract and that you agree to these Terms and to our Privacy Policy. If you are using the App on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf. If you do not agree, do not use the App.

02 License to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal or internal business use. Your use of the App distributed through Google Play is also subject to the Google Play Terms of Service.

03 Eligibility

The App is intended for users aged 13 or older (or the equivalent minimum age in your jurisdiction). If you are a minor, you may use the App only with the consent and supervision of a parent or guardian, who accepts these Terms on your behalf and is responsible for your use of the App — including the volume levels you choose.

04 Acceptable use

You agree not to, and not to attempt to:

  • Use the App for any unlawful or harmful purpose, or in any way that disturbs, harasses, or endangers other people — for example by playing amplified audio where doing so is prohibited or unsafe.
  • Use the App while driving, cycling, or in any other situation where reduced awareness of your surroundings could cause harm.
  • Reverse engineer, decompile, or disassemble the App, except to the extent this restriction is prohibited by applicable law.
  • Copy, modify, rent, lease, sell, sublicense, or create derivative works of the App.
  • Interfere with or disrupt the App, tamper with the advertising it serves, generate invalid ad traffic, or circumvent any security or technical limitation.
  • Remove or obscure any proprietary notices, or misuse our name, trademarks, or branding.

05 Hearing & device safety

Important — please read

The App can raise playback loudness above your device’s normal maximum. Listening at high volume, especially for long periods or through headphones, can cause permanent hearing damage. Excessive levels may also distort, overheat, or damage your speakers, headphones, or other audio hardware.

You are solely responsible for the volume and effect levels you choose. We strongly recommend that you:

  • Start at a low level and raise it gradually — never begin at maximum boost with headphones on.
  • Keep the level as low as is comfortable, and take regular listening breaks.
  • Reduce the level immediately if you hear distortion, crackling, or ringing in your ears, or if the audio hardware becomes hot.
  • Take extra care with children, and with volume-limited or medical hearing devices.

The App may display a warning when you select a very high level. That warning is a courtesy, not a safety guarantee, and it can be dismissed at your own risk; dismissing it does not transfer any responsibility to us. The App does not measure the actual sound pressure reaching your ears, which depends on your device, your headphones, and the material you are playing.

To the maximum extent permitted by law, you use the boost feature at your own risk and we accept no liability for hearing damage, hardware damage, or other loss resulting from the levels you choose.

06 Audio performance & device compatibility

The App uses the audio-effect interfaces provided by the Android operating system. How much additional loudness is available, how the equalizer bands behave, and whether bass or surround effects work at all depend on your device, its Android version, its audio hardware, and the app producing the sound. Some devices, some system audio modes, and some media apps restrict or ignore these effects entirely.

We therefore do not promise any particular amount of boost, any specific sound quality, or that the App will work with every media app or every device. Features may also change or be removed between versions.

07 Permissions & optional features

Some features require Android permissions that you grant, and can withdraw, at any time:

  • The microphone permission is required by Android before any app may read audio output levels; the App uses it only to animate the on-screen wave. No audio is recorded, stored, or transmitted. See section 3 of the Privacy Policy.
  • Notification access is required for the mini player to show and control what is playing.
  • Notification permission is required for the control panel in your notification shade.

Declining or revoking any of these permissions disables only the related feature. We do not condition the core boost and equalizer functions on them.

08 Third-party apps & content

The App does not host, supply, or stream any music or other media. It processes audio that other apps on your device produce, and it can display and control their playback. Those apps, the content they play, and any rights in that content belong to third parties. We do not control them, do not endorse them, and are not responsible for their availability, behavior, or terms.

You are responsible for holding any necessary rights to the content you play and for complying with the terms of the apps and services you use it with.

09 Your settings & presets

The equalizer presets you create and the settings you choose are stored on your device. You own them and are solely responsible for them, including any names you type. We do not claim ownership and, as described in the Privacy Policy, we do not upload them. Clearing the App’s data or uninstalling the App deletes them permanently, and we cannot recover them for you.

10 Advertising

The App is offered free of charge and displays advertisements, including through Google AdMob. Advertisements, and any offers, products, or services they promote, are the responsibility of the relevant advertisers, not us. We do not endorse advertised products and are not a party to any transaction between you and an advertiser.

The data collected for advertising, and your consent and opt-out choices, are described in our Privacy Policy. Interfering with the display of ads, or generating invalid traffic, is a breach of section 4.

11 Intellectual property

The App, including its software, design, text, graphics, and the “Volume Booster & Equalizer” name and logo, is owned by Wewin Software and its licensors and is protected by intellectual-property laws. Except for the license granted in section 2, no rights are transferred to you. Certain components are provided by third parties (for example AndroidX, Google Material Components, and the Google Mobile Ads SDK) under their own licenses.

12 Disclaimer of warranties

We do not warrant that the App will be uninterrupted, error-free, or secure, that it will be compatible with your device or media apps, that any level of boost or sound quality will be achieved, or that its use will be free of risk to your hearing or your equipment. You use the App at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

13 Limitation of liability

To the maximum extent permitted by law, Wewin Software and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App — including any hearing damage, damage to speakers, headphones, or other equipment, or any loss resulting from the volume, boost, or effect levels you select — even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total aggregate liability for all claims relating to the App is limited to the greater of the amount you paid for the App (if any) or SGD 20. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, or for fraud.

14 Indemnification

You agree to indemnify and hold harmless Wewin Software from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or third-party right.

15 Termination

These Terms apply while you use the App. You may stop using and uninstall the App at any time. We may suspend or terminate your license if you breach these Terms, or if we discontinue the App. Provisions that by their nature should survive termination (including sections 5 and 11–14) will survive.

16 Governing law

These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules, and the courts of Singapore will have exclusive jurisdiction over any dispute, except where mandatory consumer-protection laws of your country of residence provide otherwise.

Language. These Terms and the Privacy Policy are published in English, and the English text governs. Any translation is provided for convenience only; if a translation conflicts with the English text, the English text prevails.

Severability. If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.

17 Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, provide a more prominent notice. Your continued use of the App after an update means you accept the revised Terms.
